El otrora congresista acusaba al expersecutor de haberlo indagado injustamente y de haber afectado su reelección. Pese a ello, el 19° Juzgado Civil de Santiago rechazó en todas sus partes la acción. Gómez celebró el fallo y aseguró que era una acusación "liviana".
